{"id":16422,"date":"2019-07-31T18:33:13","date_gmt":"2019-07-31T22:33:13","guid":{"rendered":"https:\/\/www.mdcthereporter.com\/?p=16422"},"modified":"2020-06-17T15:57:31","modified_gmt":"2020-06-17T19:57:31","slug":"mdc-professors-sue-board-of-trustees-over-presidential-search","status":"publish","type":"post","link":"https:\/\/mdcthereporter.com\/staging\/8357\/mdc-professors-sue-board-of-trustees-over-presidential-search\/","title":{"rendered":"MDC Professors Sue Board Of Trustees Over Presidential Search"},"content":{"rendered":"<p><span style=\"font-weight: 400;\">Eight Miami Dade College professors have filed a lawsuit against <a href=\"https:\/\/www.mdc.edu\/about\/leadership\/trustees.aspx\"><span style=\"color: #0000ff;\">the College\u2019s District Board of Trustees<\/span><\/a> over <a href=\"https:\/\/www.mdcthereporter.com\/decision-to-reboot-presidential-search-angers-community-the-heart-and-soul-of-the-college-has-been-ripped-apart-today\/\"><span style=\"color: #0000ff;\">their decision to reopen the presidential search process<\/span><\/a>.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The lawsuit, filed in the Eleventh Judicial Court earlier today by Phillips, Richard &amp; Rind, P.A.\u2014a firm run by Mark Richard, former paralegal professor and UFMDC attorney\u2014cites that trustees violated due process laws in their decision to close, and take over, the presidential search process, and demands that the process be transparent to the public.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u201cFive hundred people inquired, 47-50 applied, seven finalists were interviewed, curriculum vitaes were poured through, meetings with students and stakeholders,\u201d Richard said during a press conference at West Campus on Wednesday morning announcing the lawsuit. \u201cThe dates were always stayed the same. The committee was complimented. [Bernie Navarro] promised, and we believed him and still do, that this would be an open and transparent process that couldn\u2019t be changed at the last minute. They changed everything in the 11th hour.\u201d<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Surrounded by about 20 MDC faculty members, Richard demanded that the Board adhere to the transparency of the current process, which consisted of a 17-member search committee made up of MDC students, faculty and local community leaders. The Board scrapped the process on July 24, citing that five of the seven members were newly appointed by Governor Ron DeSantis and did not have a familiarity with the College\u2019s vision for the president.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u201cYou want me to jump in bed at the last minute,\u201d said Marcell Felipe during an interview with CBS Miami. \u201cAt least take me to dinner, give me some wine and let\u2019s see where it leads.\u201d<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Among the seven members, four were appointed on April 24. The four were invited to an orientation program for new Board members\u2014of which all trustees except Felipe attended\u2014as well as the open forum presentations from the four finalists. In the same meeting Felipe was sworn in as a trustee on May 21, he proposed lowering the minimum educational requirements for presidential search applicants, three months into the process.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u201cWe need some time to get used to the institution, the mission, the values\u2014[to] understand where we\u2019re going before we make a decision of this magnitude,\u201d Felipe said in an interview with <\/span><i><span style=\"font-weight: 400;\">The Reporter<\/span><\/i><span style=\"font-weight: 400;\"> on July 24. \u201cFrom this point on, we have to figure out what we\u2019re going to do. I think it\u2019s the right move because this is a decision that\u2019s going to impact, not just Miami Dade College, but all of South Florida for hopefully the next generation.\u201d<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Throughout the process, the Board has recognized that the process must be \u201copen and transparent.\u201d Public meetings were held in accordance to Florida Sunshine Laws for three months. On several occasions, Chairman Bernie Navarro applauded the efforts of both the committee and Diversified Search Firm, who recruited and selected the four finalists.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u201cI felt the process was transparent. We felt those four candidates were well-qualified, otherwise we would have not moved forward,\u201d said Marie Entienne, former search committee member and nursing professor at Medical Campus on Wednesday. \u201cWhen I heard of the decision of the [Board], I was in dismay. I was extremely sad by the fact that we worked countless hours to ensure that we put forth the best of the best to lead the institution.\u201d<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The College will have 20 days to respond to the lawsuit. According to MDC legal counsel Javier Ley-Soto, the College is\u00a0 undecided on how to proceed with the case; they have not determined if an internal or external lawyer will be used.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The firm representing the professors sent Hogan Lovells US LLP., an outside legal counsel for the College, an official notice this morning to preserve electronic evidence and handwritten notes from current trustees along with their respective staff and advisors accumulated during the presidential search.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The plaintiffs in the lawsuit are: <\/span><b>Susan E. Garcia<\/b><span style=\"font-weight: 400;\">, a music professor at New World School of the Arts; <\/span><b>Elizabeth Ramey<\/b><span style=\"font-weight: 400;\">, an English professor at Wolfson Campus and UFMDC president; <\/span><b>A.J Krieder<\/b><span style=\"font-weight: 400;\">, a philosophy professor at Homestead Campus; <\/span><b>Irene Lipof<\/b><span style=\"font-weight: 400;\">, a retired education and social sciences professor, <\/span><b>Annete Gibson<\/b><span style=\"font-weight: 400;\">, a retired nursing professor; <\/span><b>Sarah Garman, <\/b><span style=\"font-weight: 400;\">a humanities professor at North Campus, <\/span><b>Marie Entienne<\/b><span style=\"font-weight: 400;\">, a nursing professor at Medical Campus; <\/span><b>Rosany Alvarez<\/b><span style=\"font-weight: 400;\">, a mathematics professor at Eduardo J. Padron Campus.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The professors suing the Board, some of whom are currently employed as tenured employees of the College, said the lawsuit will not affect their classes this coming fall semester. According to MDC director of communications Juan Mendieta, the professors are guaranteed protection because the suit doesn\u2019t violate their contract.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u201cWe will never compromise the quality of this college,\u201d Richard said. \u201cOur bond with our students is unbreakable, and five trustees can\u2019t ever change
